The court granted anticipatory bail to the petitioner, subject to specified conditions.
Summary
The petitioner, Sourav Kumar, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act for the alleged possession of 439.89 litres of illegal foreign liquor. He contended that the liquor was recovered from a co‑accused, Rahul Kumar, and that the recovery violated mandatory procedures under Sections 103 and 105 of the Bhartiya Nagarik Suraksha Sanhita, with no other material linking him to the offence. The prosecution opposed anticipatory bail, invoking Section 76(2) of the Bihar Prohibition and Excise Act and citing three pending criminal cases against the petitioner. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar (2019 PLJR 1089), the court found merit in the petitioner's claim of lack of direct evidence and procedural lapses. Consequently, the court granted anticipatory bail subject to a Rs.10,000 bond, two sureties, and conditions under Section 438(2) of the CrPC and Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita.
Issues considered
- Whether anticipatory bail can be granted in a case under the Bihar Prohibition and Excise Act despite the presence of prior criminal antecedents.
- Whether procedural irregularities in the recovery of illegal liquor under Sections 103 and 105 of the Bhartiya Nagarik Suraksha Sanhita justify the grant of anticipatory bail.
- Effect of Section 76(2) of the Bihar Prohibition and Excise Act on the availability of anticipatory bail.
