Patna High Court

Dipesh Singh @ Sudarshan Singh @ Suman SisodiyaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Dipesh Singh, was arrested in connection with a murder case (Habibpur PS Case No.75 of 2023) alleged under IPC sections 302, 120(B)/34 and Arms Act section 27, stemming from a money dispute. The FIR alleges that he and other accused killed the brother of an informant, but there is no eyewitness evidence and the prosecution’s case rests on suspicion. The petitioner contended his innocence and highlighted that a similarly situated co‑accused, Gautam Kumar, had already been granted regular bail by the same court. The State opposed the bail, arguing the seriousness of the offences. Considering the nature of the accusation, the length of custody since 9 October 2025, and the lack of substantive evidence, the court allowed the bail application, directing release on a bond of Rs 10,000 with two sureties.

Issues considered

  • Whether regular bail can be granted in a murder and conspiracy case under Sections 302, 120(B)/34 IPC and Section 27 Arms Act given the circumstances of the case.
