Patna High Court

Sudhir Pandit @ Sudhir Kumar PanditversusThe State Of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

Sudhir Pandit was arrested in connection with a 2020 case alleging cheating, defamation, sexual assault, and cyber‑cheating under IPC sections 420, 499, 500, 354(C) and IT Act section 66(D). The allegations stem from his purported friendship with the informant’s sister, false claims about his caste, a marriage proposal, and creation of a fake Facebook ID to post derogatory material. The petitioner sought regular bail, arguing that the impersonation claim lacked material evidence, no illegal benefit was derived, and he had already been granted bail in a separate matter. The State opposed bail, emphasizing the seriousness of the offences. After hearing both sides, the court considered the custody period and the absence of concrete proof of the alleged social‑media posts and granted bail on a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail despite charges under IPC 420, 499, 500, 354(C) and IT Act 66(D).
  • Whether the prosecution has produced sufficient material evidence of impersonation and derogatory posts to justify denial of bail.
  • Whether the nature of the alleged offences warrants continued judicial custody.
