Patna High Court

Manoj Agrahari @ Manoj Kumar AgrahariversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner on the condition of a Rs.10,000 bond with two sureties.

Summary

Manoj Agrahari applied for bail after being in custody since 29-10-2025 in a case where an informant allegedly paid money to secure a government job, an illegal act. The petitioner argued that he was the victim and that no money was ever transferred to his account, contending that he could not be considered a cheat. The earlier bail application had been rejected on 25-08-2025. The court noted that the charge‑sheet had already been filed and that the period of custody was considerable. Considering these factors, the court ordered that the petitioner be released on bail upon furnishing a bail bond of Rs.10,000 with two sureties of the same amount, subject to the satisfaction of the Judicial Railway Magistrate. The bail was thus granted.

Issues considered

  • Whether the petitioner, who claims to be a victim and alleges no receipt of money, is eligible for bail despite the earlier rejection of his bail application.
  • Whether the filing of the charge‑sheet and the length of custody justify granting bail.
