Holding

The Court granted regular bail to the petitioner, directing release upon furnishing a bail bond with sureties.

Summary

Ankush Kumar, the brother‑in‑law of the complainant, was charged under Sections 189(2), 126(2), 115, 352, 109 and 85 of the Bihar Penal Code (BNS) and Sections 3 and 4 of the Dowry Prohibition Act for allegedly assaulting his sister‑in‑law with slaps, fists and bricks after taking her to a secluded forest area, with the intent to cause death. The petitioner applied for regular bail, contending that the allegations were vague, that he had been in custody since 23‑09‑2025, and that co‑accused including the husband had already been granted bail in similar cases (Cr. Misc. Nos. 52672 of 2025 and 4558 of 2025). The State opposed the bail, emphasizing the seriousness of the offences. The Court, after considering the facts, the precedent of bail to co‑accused, and the lack of a specific prima facie case, ordered the petitioner to be released on bail upon furnishing a bond of Rs.10,000 with two sureties. The order was pronounced by Justice Ashok Kumar Pandey.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the gravity of offences under the BNS and Dowry Prohibition Act.
  • Whether the alleged general and omnibus nature of the charges justifies bail.
  • Whether the grant of bail to co‑accused in related cases is a relevant factor.
