BAIL GRANTED

Holding

The Court allowed the petition for anticipatory bail, subject to conditions under Section 482(2) of the B.N.S.

Summary

The petitioner, Pradeep Sharma, sought anticipatory bail in connection with a case (PS Case No. 280 of 2025) alleging assault and homicide under several sections of the B.N.S. The FIR was lodged nine days after the incident, and the deceased died after treatment for injuries allegedly inflicted by co‑accused Guddu Yadav and Ajeet Yadav. The petitioner argued he had no criminal antecedents, was not armed, and the injuries were to non‑vital parts of the body. The State opposed the bail, contending the seriousness of the offences. The Court examined the delay in filing the FIR, the nature of the injuries, and the statutory provisions, and ordered that the petitioner be granted anticipatory bail on furnishing a bail bond with two sureties, subject to conditions under Section 482(2) of the B.N.S. The application was allowed.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under Section 482(2) of the B.N.S. despite the serious nature of the offences alleged.
  • Whether the nine‑day delay in lodging the FIR and the circumstances of the injuries justify denial of bail.
  • Whether the petitioner poses a risk of fleeing, tampering with evidence, or influencing witnesses.
