Patna High Court

Tetari DeviversusThe State of Bihar

Decided
Disposal
WITHDRAWN

Holding

The court held that the case is to be disposed of as infructuous.

Summary

Tetari Devi was the petitioner in a criminal miscellaneous case before the Patna High Court. During the pendency of the proceedings, she was arrested, leading her counsel to argue that the case had become infructuous. The petitioner sought disposal of the matter on that ground. The court considered the submission that an arrest renders the pending criminal case moot. No detailed reasoning was recorded beyond the acknowledgment of the petitioner's claim. Accordingly, the court disposed of the case as infructuous.

2 16-04-2026 The learned counsel for the petitioner submits that

during the pendency of this case, the petitioner has already been

arrested and, therefore, this case has become infructuous. He,

accordingly, prays that the present case may be disposed of as

                      having become infructuous.

                                   2. For the reasons stated above, the case is disposed of

                      as having become infructuous.
