Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Bimal Choudhary, was arrested in connection with a murder case (Muffasil P.S. Case No. 398/2024) alleged under Sections 103 and 3(5) of the B.N.S. and Section 27 of the Arms Act. The prosecution alleged that a trivial dispute led to a shooting by Ravin Choudhary, resulting in the death of the informant’s brother. The petitioner claimed innocence, asserted that no specific allegation was made against him, and highlighted his clean antecedent and willingness to cooperate with the trial. The State opposed the bail application, while the petitioner’s counsel sought regular bail. The court, after considering the facts and circumstances, granted regular bail on the condition of a Rs.10,000 bond with two sureties and required the petitioner to cooperate with the trial proceedings.
