Patna High Court

Sujeet KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, holding that the injury was not caused by him and bail is permissible under the B.N.S.

Summary

The petitioner, Sujeet Kumar, was arrested in connection with a dispute over a boundary where the informant alleged assault with bricks, leading to injuries. The FIR listed offences under Sections 126(2), 115(2), 109, 352, 351(2) and 351(3) of the Bharatiya Nyaya Sanhita, 2023. The petitioner’s counsel argued that the informant’s head injury resulted from a fall after villagers intervened, not from any assault by the petitioner, and highlighted the petitioner’s clean antecedents. The State opposed bail, citing the injury report. The Court examined the facts, noted that the head injury was not caused by the petitioner, and applied the bail provisions of the B.N.S. to grant bail on a bond of Rs.30,000 with conditions under Section 482(2). The order released the petitioner on bail pending surrender or arrest within four weeks.

Issues considered

  • Whether bail should be granted to the petitioner despite the pending charges under the Bharatiya Nyaya Sanhita.
  • Whether the injury to the informant was caused by the petitioner, justifying denial of bail.
