Patna High Court

Mani Ram YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond of Rs.10,000, two sureties and specified conditions.

Summary

Mani Ram Yadav was arrested on 16 February 2026 in connection with an FIR dated 15 February 2026 alleging violation of Section 30(a) of the Bihar Prohibition and Excise Act, 2018 for the recovery of 585 litres of illicit liquor from three motorcycles that he does not own. The petitioner claimed innocence, arguing that the seized liquor was not in his conscious possession and that the investigation failed to comply with Sections 103 and 105 of the BNSS. The prosecution opposed bail, citing a prior criminal antecedent of a similar nature, but also noted that the petitioner was already on bail in the same matter. The High Court, after considering the submissions, granted bail on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of the antecedent. The order directed that bail should not be delayed for verification purposes.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.
  • Whether non‑compliance of Sections 103 and 105 of the BNSS warrants denial of bail.
  • Whether the petitioner’s prior criminal antecedent affects the grant of bail.
