Ravi Mahto @ Ravi Kumar MahtoversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The court granted bail to the petitioner, finding no sufficient grounds to deny his release.

Summary

The petitioner, Ravi Mahto, applied for bail in a case (Balwahat P.S. Case No. 18 of 2025) where he is accused of murdering his wife by poisoning, under Sections 80, 108, 61(2) and 3(5) of the BNS. He has been in custody since 4 March 2025. The petitioner’s counsel argued that he is innocent and that the deceased actually committed suicide following a trivial dispute. The court examined the allegations and the lack of conclusive evidence linking the petitioner to the alleged homicide. Finding the petitioner's claim credible and noting the absence of a strong prima facie case, the court allowed the bail application. The petitioner was ordered to be released on bail upon furnishing a bond of Rs. 10,000 with two sureties of the same amount, subject to the satisfaction of the Judicial Magistrate, 1st Class, Saharsa.

Issues considered

  • Whether bail should be granted to the accused in a murder‑poisoning case under Sections 80, 108, 61(2) and 3(5) of the BNS
  • Whether the evidence presented by the prosecution establishes a prima facie case against the petitioner
