Anticipatory bail was refused.
Summary
The petitioner, Ruchi Kumari, proprietor of Aaradhya Pharma Agency, applied for anticipatory bail in a case registered under Sections 8(C), 21(C) and 29 of the Narcotic Drugs and Psychotropic Substances Act. The prosecution alleged that a raid on a freight carrier’s godown recovered 479 litres of illegal codeine syrup, cash, a mobile phone and, notably, 2,880 bottles of 100 ml codeine syrup bearing the petitioner’s company name. The court examined the magnitude of the seizure and the petitioner’s ownership of the agency implicated in the illegal possession. Considering the substantial quantity of narcotics recovered and the material evidence linking the petitioner’s firm to the contraband, the court concluded that the circumstances did not merit the grant of anticipatory bail. Consequently, the petition for anticipatory bail was rejected.
Issues considered
- Whether anticipatory bail can be granted to the proprietor of a pharma agency when a large quantity of narcotic drug (codeine syrup) is recovered in the name of the agency under the NDPS Act.
