Patna High Court

Raman Kishor Kumar @ Raman KishoreversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner, directing a bail bond of Rs 10,000 with two sureties.

Summary

The petitioner, Raman Kishor Kumar, husband of the complainant Rubi Devi, was charged under IPC sections 323, 325, 504, 406, 497, 498A and Dowry Prohibition Act sections 3 and 4 for alleged abuse and dowry demands. He had earlier been granted anticipatory bail but the bail bond was cancelled because he failed to pay a court‑ordered maintenance of Rs 5,000, leading to his custody from 18 September 2025. The petitioner applied for regular bail, asserting false implication and willingness to cooperate, while the State argued non‑compliance with the maintenance condition. The court noted the petitioner had been in custody for over six months and directed that he appear in the pending maintenance case within four weeks. Considering the circumstances, the court ordered regular bail on a bond of Rs 10,000 with two sureties of the same amount, subject to satisfaction of the Judicial Magistrate.

Issues considered

  • Whether the petitioner is entitled to regular bail despite failure to comply with the maintenance condition imposed during anticipatory bail
  • Whether the prolonged custody of more than six months justifies granting bail
