BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to compliance with the mediation compromise and statutory conditions.

Summary

Vivek Anand, husband of complainant Pooja Kumari, feared arrest in a dowry harassment complaint (Case No. 882 of 2023) alleging offences under IPC sections 504, 323, 379, 498A and Section 3 of the Dowry Prohibition Act. He contended that the allegations were false, noting a prior matrimonial suit under the Hindu Marriage Act that was decided in his favour. The High Court ordered mediation, resulting in a compromise agreement signed on 22 December 2025. Both parties supported the settlement. Considering the compromise, the Court granted the petitioner anticipatory bail, subject to a bail bond of Rs.10,000, two sureties, and strict compliance with the mediation terms, under Section 482(2) of the CrPC.

Issues considered

  • Whether anticipatory bail can be granted in a dowry harassment case where the parties have reached a mediated compromise
