Holding

The petitioner is entitled to anticipatory bail subject to the conditions imposed by the Court.

Summary

The petitioner, Ranjeet Yadav, filed an anticipatory bail application fearing arrest in a case (PS No. 398 of 2025) under Sections 25(1‑B)a, 26 and 35 of the Arms Act. The prosecution alleged that a pistol and live cartridge were recovered from a co‑accused, Anil Yadav, and that the petitioner was implicated. The petitioner contended that nothing was recovered from him, he has no criminal antecedent and is falsely implicated. The State opposed the bail. The Court, after considering the lack of material against the petitioner and his clean record, ordered that he be granted anticipatory bail subject to surrendering within four weeks and furnishing a bail bond of Rs.10,000 with two sureties, under the conditions of Section 482(2) of the CrPC.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 of the CrPC in view of the allegations under the Arms Act.
  • Whether the absence of any seized weapon or ammunition from the petitioner and his clean antecedent justify granting bail.
