BAIL GRANTED

Holding

The court held that the petitioner is entitled to regular bail because he was not arrested at the spot, no incriminating article was recovered from him, and he had been detained for an extended period.

Summary

The petitioner applied for regular bail under section 30(a) of the Bihar Prohibition and Excise Act, 2016 after being implicated in a liquor‑smuggling case. The prosecution alleged that the accused, including the petitioner, were seen with motorcycles carrying liquor, but the petitioner was not arrested at the spot and no liquor or vehicle was recovered from his possession. He had been in custody since 17 February 2026. The petitioner argued that he was falsely implicated and offered to cooperate with the investigation. The court, noting the absence of arrest at the scene, lack of incriminating material against him, and the length of his detention, ordered that he be released on bail upon furnishing a bond of Rs.10,000 with two sureties. The bail order was directed to be satisfied before the Exclusive Special Judge of the Excise Court, Buxar.
