The court dismissed the bail application, refusing to grant regular bail to the accused.
Summary
Arun Mandal, charged under section 302 of the Indian Penal Code for allegedly assaulting the informant’s father leading to his death, applied for regular bail before the Patna High Court. The petitioner had previously sought bail twice, both applications being rejected. The counsel argued that all witnesses had been examined in the trial, which was nearing its conclusion. The court considered the seriousness of the murder charge and the advanced stage of the trial, and therefore declined to revisit its earlier decisions. Consequently, the bail application was dismissed, leaving the petitioner in custody.
