Md. Kafil Alam @ Kafil @ Md. KafilversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond and specified conditions.

Summary

Md. Kafil Alam was arrested on 27 February 2026 in connection with a case involving the seizure of 276 litres of Nepali liquor from a motorcycle, alleged to violate Sections 30(a), 32(2) and 41 of the Bihar Prohibition and Excise Act, 2018. The petitioner contended that he was not in actual possession of the liquor or the vehicle and that the investigation failed to comply with Sections 103 and 105 of the BNSS, rendering the charge based merely on suspicion. The prosecution opposed bail, citing a prior criminal antecedent. The High Court, after considering the submissions, granted bail on a bond of Rs.10,000 with two sureties and imposed conditions of cooperation, non‑tampering with evidence, and verification of the antecedent. The order directed that bail should not be delayed for verification purposes.

Issues considered

  • Whether bail should be granted to the petitioner despite the alleged offences under the Bihar Prohibition and Excise Act, 2018.
  • Whether non‑compliance of Sections 103 and 105 of the BNSS warrants denial of bail.
  • Whether the petitioner’s prior criminal antecedent precludes the grant of bail.
