Patna High Court

Umesh Chaudhary @ Umesh Kumar ChaudharyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, Umesh Chaudhary.

Summary

The petitioner, Umesh Chaudhary, applied for anticipatory bail after being named by a chowkidar in a police raid that recovered illicit liquor under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The police seized 25 litres of country-made liquor and 2000 litres of fermented liquor from an open pond area, and the chowkidar identified the petitioner as one of the four persons who fled. The petitioner argued that his inclusion was false, the location was a public space, and that similarly situated co‑accused had been granted anticipatory bail by the same court. The court considered the basis of the petitioner’s identification and the precedent of bail being granted to co‑accused. It held that the petitioner was entitled to anticipatory bail and ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The application was allowed.

Issues considered

  • What is the appropriateness of granting anticipatory bail to the petitioner named by a chowkidar in a case under the Bihar Prohibition and Excise Act?
  • Does the identification of the petitioner in an open public area and the grant of bail to co‑accused warrant similar relief for the petitioner?
