Patna High Court

Niraj Kumar Sah @ Niraj KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to specified conditions.

Summary

Petitioner Niraj Kumar Sah was arrested on 1 March 2026 in connection with a case under Section 30(a) of the Bihar Prohibition & Excise Act, 2016, involving the recovery of 300 litres of country-made liquor from a river bank. He pleaded that he has a clean antecedent, was falsely implicated, and that the seizure was not in his possession. The petitioner also argued that the investigation failed to comply with Sections 103 and 105 of the Bihar Narcotic Substances (BNSS) Act, 2023, and that the witnesses were police personnel. The State opposed bail, but the Court noted the lack of possession, clean record, and procedural lapses, and therefore granted bail on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, appearance, and non‑tampering with evidence. The bail order also directed verification of the petitioner’s antecedents and allowed cancellation if conditions are breached.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.
  • Whether the investigation complied with the procedural requirements of Sections 103 and 105 of the BNSS, 2023.
  • Whether the petitioner’s clean antecedent and lack of possession justify granting bail.

  • bail
  • prohibition act
  • illicit liquor
