Patna High Court

Ankush KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted because the petitioner had no conscious possession of the seized liquor and the investigation failed to comply with statutory provisions, coupled with his clean antecedent.

Summary

Ankush Kumar was arrested on 30 January 2026 in connection with a case involving the seizure of 373 litres of country‑made liquor, alleged to be an offence under Section 30(a) of the Bihar Prohibition & Excise Amendment Act, 2022. The petitioner contended that the liquor was not in his conscious possession, he has a clean antecedent, and that the investigation failed to comply with Sections 103 and 105 of the Bihar Narcotic Substances (BNSS) Act, 2023. The State opposed bail. The High Court, after considering the lack of conscious possession and the procedural lapses, ordered the petitioner’s release on bail upon furnishing a bond of Rs 10,000 with two sureties and imposed conditions regarding cooperation, non‑tampering with evidence, and verification of antecedents. The bail order was directed to be implemented by the District & Additional Sessions Judge‑IV‑cum‑Exclusive Special Excise Court‑II, Gopalganj.

Issues considered

  • The petitioner is entitled to bail despite the seizure of a large quantity of illicit liquor.
  • Whether the absence of conscious possession and non‑compliance with Sections 103 and 105 of the BNSS, 2023 justify granting bail.
