The Court granted bail to all three petitioners, directing them to furnish a bond of Rs 10,000 with two sureties each.

Summary

The petitioners, Md. Jabir Alam, Md. Aijaj Alam and Md. Zameer Alam, were arrested in connection with a case registered under Sections 8(c) and 21(c) of the NDPS Act after police recovered 52.44 g, 124.78 g and 124.78 g of "smack" respectively, along with cash and mobile phones. They applied for bail, contending that they were falsely implicated, that the seized quantities, though above the "small quantity" threshold, were far below commercial quantity, and that a co‑accused had already been released on bail. The State opposed the bail, noting that the third petitioner had prior criminal cases, though the first two had no antecedents. After hearing both sides, the Court considered the nature of the quantity, the lack of prior record for two petitioners, and the principle of liberty, and decided to grant bail. Each petitioner was ordered to furnish a bail bond of Rs 10,000 with two sureties to the satisfaction of the Sessions Judge‑c‑m Special Judge, NDPS Act, Kishanganj.

Issues considered

  • Whether bail can be granted to accused under the NDPS Act when the quantity seized exceeds the statutory ‘small quantity’ but is less than ‘commercial quantity’
  • Whether the presence of prior criminal antecedents for one accused precludes the grant of bail
  • Whether the grant of bail to a co‑accused influences the decision on bail for the remaining accused
