Patna High Court

Manisha KumariversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is to be granted to the petitioner subject to the stipulated conditions.

Summary

Manisha Kumari, the petitioner, was named in an FIR for alleged defalcation of Rs. 8,84,534 under IPC sections 406, 409 and 420/34. She claimed that the cheque in question was signed under the instruction of her mother‑in‑law and was a joint signature, and that she has a clean antecedent. The State opposed her request for anticipatory bail. The court, noting her clean record and the joint nature of the cheque, granted anticipatory bail subject to a bond of Rs.10,000 and two sureties, and conditioned the bail on compliance with Section 438(2) of the Cr.P.C. and Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita. The order directed that she surrender within four weeks if arrested.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in the case of alleged cheque fraud under IPC sections 406, 409, 420/34.
