Patna High Court

Anjanee KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond and specified conditions.

Summary

Anjanee Kumar was arrested on 30 January 2026 in connection with an FIR alleging that he accepted a bribe of Rs.20,000, violating Section 7 of the Prevention of Corruption Act, 1988 and Section 61(2)(A) of the Bihar Narcotic Substances Act. The petitioner sought bail, claiming a clean antecedent and that the FIR was fabricated, and pointed out that a co‑accused, Ravi Shankar Ram, had been granted bail by a coordinate bench. The vigilance department opposed bail, noting that a chargesheet had been filed. The court, considering the petitioner’s clean record and the precedent of bail to the co‑accused, ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions of cooperation, appearance, and non‑tampering with evidence. The bail order also directed verification of the petitioner’s criminal antecedent without delaying the release.

Issues considered

  • Whether bail should be granted to the petitioner despite the charges under the PC Act and B.N.S. Act.
  • Whether the petitioner’s clean antecedent and the bail granted to a similarly situated co‑accused justify release.
  • Whether the filing of a chargesheet alone is sufficient to deny bail.
