Holding
The court granted regular bail to the petitioner.
Summary
Pappu Prasad was arrested in connection with a shooting incident in which Upendra Kumar was injured in the leg. He faced charges under several sections of the BNS and Section 27 of the Arms Act. The petitioner sought regular bail, arguing innocence, lack of repeated firing, and that the injury was non‑grievous as per the medical report. The State opposed the bail application. After hearing both sides, the court found the circumstances sufficient to grant bail, directing the petitioner to be released on a bond of Rs.10,000 with two sureties.
Issues considered
- Whether regular bail should be granted to the petitioner despite the serious charges under the BNS and Arms Act.
- Whether the nature of the injury (non‑grievous) and lack of repeated firing justify bail.
