The Court granted anticipatory bail to the petitioner subject to specified conditions and verification of criminal antecedent.
Summary
Manjeet Kumar (Monu) sought anticipatory bail in connection with Sultanganj Police Station Case No. 420 of 2025, which alleged his involvement in an assault on a police informant and theft of Rs.1100, invoking several sections of the Bharatiya Nagarik Suraksha Sanhita (BNS). The petitioner claimed innocence and that the allegations were fabricated, while the State opposed bail. The Court noted that the alleged participation was limited to a scuffle and possibly did not cause injury, and therefore considered granting anticipatory bail. It ordered that the petitioner be released on bail upon furnishing a Rs.10,000 bond with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the BNS. Additional conditions required the petitioner’s cooperation with the investigation and allowed the lower court to cancel bail if a concealed criminal antecedent was discovered. The bail order was conditioned on an expeditious verification of the petitioner’s criminal record.
Issues considered
- Whether anticipatory bail should be granted to the petitioner given the allegations under multiple sections of the BNS.
- Whether the petitioner’s alleged involvement in the scuffle warrants denial of bail.
