The court granted anticipatory bail to the petitioner, subject to specified conditions and a bail bond.
Summary
Munna Chaudhary sought anticipatory bail after being implicated in a case involving the recovery of 400 litres of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise Act. He argued that the liquor was seized from a vehicle and that he had no conscious possession, asserting that the FIR was fabricated. The prosecution opposed bail, invoking Section 76(2) of the same Act and citing the petitioner’s prior criminal antecedents. The court, relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar, granted anticipatory bail subject to a bail bond of Rs.10,000, two sureties, and conditions under Section 438(2) of the CrPC and Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, including cooperation with the trial and no tampering with evidence.
Issues considered
- Whether anticipatory bail can be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act despite the provisions of Section 76(2).
- Whether the petitioner’s prior criminal antecedents preclude the grant of anticipatory bail.
- Whether the procedural requirements for recovery under Section 100 of the CrPC/Section 103 of the Bhartiya Nagarik Suraksha Sanhita were complied with.
