Patna High Court

Vivek YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted subject to conditions under Section 438(2) Cr.P.C. and Section 482(2) B.N.S.S.

Summary

Vivek Yadav was implicated in a diesel‑theft case (PS Dumariyaghat Case No. 358 of 2025) and charged under Sections 303(2), 317(4) and 317(5) of the B.N.S. He applied for bail, arguing that no diesel was recovered from his possession and that the seizure was not witnessed by an independent person, violating statutory search‑seizure requirements. The State opposed bail, citing two prior criminal antecedents, although it noted that the petitioner was already on bail in all other matters. The Court examined the lack of physical recovery and procedural lapses in the seizure, and held that these factors outweighed the State’s objections. Consequently, the Court ordered that the petitioner be released on bail upon furnishing a Rs 10,000 bond with two sureties, subject to conditions under Section 438(2) Cr.P.C. and Section 482(2) B.N.S.S., including cooperation with the investigation and a family member as one bailor.

Issues considered

  • Whether bail should be granted in view of the absence of recovered contraband and alleged violation of seizure procedures.
  • Whether the petitioner’s prior criminal antecedents justify denial of bail.
