The petition for regular bail was dismissed as infructuous because the trial had already been concluded.

Summary

The petitioner, Sumit Singh, filed a petition seeking regular bail in connection with Session Trial No. 190 of 2024 arising from a 2019 case involving offences under Sections 324, 307, 120B, 506/34 of the Indian Penal Code and Section 27 of the Arms Act. The petition was filed after the trial had already concluded. The learned counsel argued that because the trial was over, the bail petition was rendered infructuous. The Court examined whether a bail application could be entertained post‑conviction or after the trial’s conclusion. Finding that the purpose of bail is to secure liberty pending trial and that the trial was complete, the Court held the petition could not be entertained. Consequently, the petition was disposed of as infructuous.

Issues considered
