Patna High Court

Sonelal Paswan @ Gonaur PaswanversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court dismissed the bail application, refusing regular bail to the petitioner.

Summary

The petitioner, Sonelal Paswan, applied for regular bail in a case registered in 2015 involving offences under Sections 364, 302 and 120B of the Indian Penal Code, relating to the kidnapping and murder of the informant's husband. The prosecution alleged that the petitioner, along with others, received a contract (supari) from Sanju Devi and participated in the killing. The petitioner had been in custody since January 13, 2026 and was also an absconder in the 2015 case. The court examined the material on record, noting the seriousness of the charges and the petitioner’s status as an absconder. Consequently, the court declined to grant bail, dismissing the application while clarifying that its observations were limited to the bail issue and did not prejudice the trial’s merits.

Issues considered

  • Whether regular bail should be granted to an accused who is an absconder and faces charges of kidnapping, murder and criminal conspiracy
  • Whether the existence of a supari (contract killing) allegation affects the grant of bail
