The Court granted anticipatory bail to the petitioners under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita.
Summary
Sabita Devi and Sahil Kumar were named in an FIR (Bidupur P.S. Case No.497 of 2025) alleging assault and related offences under various sections of the Bhartiya Nagarik Suraksha Sanhita. They filed an anticipatory bail application, claiming innocence, lack of specific allegations against them, no criminal antecedent, and asserting a case of case and counter‑case with the informant. The State opposed the bail. The Court examined the FIR and found no specific charge of assault against the petitioners and noted the dispute between the parties. Consequently, the Court granted anticipatory bail, directing the petitioners to furnish bail bonds and sureties, subject to conditions under Section 482(2) of the BNS.
Issues considered
- Whether anticipatory bail should be granted to the petitioners despite the FIR alleging multiple offences.
- Whether the FIR contains specific allegations of assault against the petitioners.
