Anticipatory bail was granted to the petitioner subject to a bond and conditions under the BNSS, 2023.
Summary
Kalindi Devi sought anticipatory bail after the police alleged that 9 litres of illicit foreign liquor were recovered from a motorcycle linked to her. The prosecution charged her under IPC sections 272, 273, 308 and 34, read with sections 30(a), 38(i) and 41(i) of the Bihar Prohibition and Excise Act, 2016. The petitioner argued she was not present at the scene, had a clean criminal record, and the vehicle was used by family members, not her. The State opposed bail but did not dispute her clean antecedent. The court, considering the lack of personal involvement and clean record, granted anticipatory bail subject to a Rs.30,000 bond and conditions under the BNSS, 2023, including verification of antecedents and possible cancellation if false information is discovered.
