Patna High Court

Gannu Uraw @ Nehru UrawversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the petitioner's application for regular bail subject to specified conditions.

Summary

The petitioner, Gannu Uraw, was arrested in connection with an assault case (Amdanda P.S. Case No. 78 of 2025) and charged under several sections of the Bharatiya Nyaya Sanhita, 2023. He claimed innocence, a clean antecedent, and highlighted that a co‑accused had been granted regular bail in a similar case. The State opposed the bail application. The Court considered the length of custody, the absence of specific allegations against the petitioner, and his clean antecedent, and consequently allowed regular bail. Bail was granted on a bond of Rs.10,000 with two sureties, subject to monthly police station attendance, cooperation with the trial, and verification of his antecedent. The order was made expressly prima facie and not on the merits of the case.

Issues considered

  • Whether regular bail should be granted to the petitioner despite multiple serious charges under the Bharatiya Nyaya Sanhita, 2023
  • Whether the petitioner’s clean antecedent and the precedent of bail granted to a co‑accused justify release on bail
