DISMISSED

Holding

The bail application was dismissed, and the petitioner was not granted bail.

Summary

The petitioners, named Amarjeet, Indrajeet and Inarjit Yadav, challenged their inclusion in an FIR that incorrectly recorded their father's name. They were charged under Sections 191(3), 190, 126(2), 109, 352 of the B.N.S. and Section 27 of the Arms Act for allegedly firing at a victim. The petitioners sought regular bail, claiming false implication, lack of prior criminal record, and willingness to cooperate with the trial, having been in custody since 2 October 2025. The State and the informant opposed the bail application. The Patna High Court, after hearing counsel, declined to grant bail, finding the circumstances insufficient for release, and dismissed the bail application.

Issues considered

  • Whether the petitioner is entitled to bail for offences under Sections 191(3), 190, 126(2), 109, 352 of the B.N.S. and Section 27 of the Arms Act
  • Whether the petitioner has been falsely implicated in the FIR
