Patna High Court

Dilip UrawversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner subject to specified conditions.

Summary

The petitioner, Dilip Uraw, was arrested in connection with a police case (No. 78 of 2025) for alleged assault and charged under multiple sections of the Bharatiya Nyaya Sanhita, 2023. He applied for regular bail, asserting innocence, a clean antecedent, and pointing to a co‑accused who had been granted bail in a similar case. The State opposed the bail application. The Court considered the length of custody, the absence of specific allegations against the petitioner, and the precedent of bail to the co‑accused, and consequently allowed the bail application. The petitioner was ordered to furnish a bail bond of Rs. 10,000 with two sureties and to comply with conditions of monthly police‑station attendance and regular trial participation. The order was made on a prima facie basis and does not prejudice the merits of the trial.

Issues considered

  • Whether regular bail should be granted to the petitioner under the Bharatiya Nyaya Sanhita, 2023 given the nature of the charges and the circumstances of custody.
