BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioners, Raju Kumar Tiwari and Birendra Tiwari, sought anticipatory bail fearing arrest in a case registered under multiple sections of the Bharatiya Nagarik Suraksha Sanhita, 2023, relating to alleged free‑fighting and assault on the informant’s sister resulting in a fractured finger. They contended that no specific allegation of assault was made against them and that they have only one disclosed criminal antecedent. The State opposed the bail, arguing the seriousness of the offences. The Court examined the lack of a direct charge against the petitioners, the existence of a case‑and‑counter‑case, and the limited criminal history, and consequently exercised its power under Section 482(2) of the B.N.S. to grant anticipatory bail. The order directed the petitioners to furnish a bail bond of Rs 10,000 with two sureties each, subject to conditions laid down by the Judicial Magistrate of Gopalganj.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
  • Whether there is a specific allegation of assault against the petitioners sufficient to deny bail.
  • Whether the petitioners’ limited criminal antecedent warrants the grant of bail.
