Patna High Court

KAUSHAL KUMARversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioners subject to the conditions specified by the Court.

Summary

The petitioners, Kaushal Kumar and Bhupesh Kumar, were arrested in connection with the recovery of 271 litres of illicit liquor and charged under Section 30(a) of the Bihar Prohibition and Excise Act. They applied for bail, claiming innocence, a clean antecedent, and offering to donate Rs. 25,000 to charity without admitting guilt. The State opposed the bail. The High Court considered the facts, the petitioners' clean record, and the nature of the offence, and ordered that bail be granted on the condition of a Rs.10,000 bond per petitioner with two sureties, a cumulative donation of Rs.25,000 to Ramakrishna Mission, verification of antecedents, and regular attendance at the police station. The order also stipulated that any involvement in other cases or failure to appear would lead to cancellation of bail. The Court clarified that its observations were limited to the bail application and did not prejudice the trial.
