BAIL GRANTED

Holding

Bail was granted to the petitioner on a bond of Rs. 10,000 with conditions, as the court found no sufficient ground to deny bail.

Summary

Petitioner Raju Mahto was arrested on 8 March 2026 in connection with the seizure of 85 litres of illicit country-made liquor alleged under Section 30(a) of the Bihar Prohibition and Excise Act, 2018. He contended that he has a clean antecedent, that the liquor was recovered from behind his house and not from his conscious possession, and that the investigating authorities failed to comply with Sections 103 and 105 of the BNSS. The Additional Public Prosecutor opposed bail. The Court, noting the petitioner’s clean record and the alleged procedural lapses, granted bail on a bond of Rs. 10,000 with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of antecedents. The bail order was directed to be implemented by the Exclusive Special Judge (Excise)‑1st, Samastipur.

Issues considered

  • Whether bail should be granted to the petitioner despite the seizure of illicit liquor under the Bihar Prohibition and Excise Act.
  • Whether the alleged non‑compliance with Sections 103 and 105 of the BNSS warrants bail.
  • Whether the petitioner’s clean antecedent and lack of conscious possession affect the bail decision.
