The Court granted bail to the petitioners, subject to a cash bond, sureties and specific conditions.
Summary
The Patna High Court entertained bail applications filed by Babloo Singh (also known as Sushil Singh) and Chhotu Mahto (also known as Aman Kumar), who were accused in FIR No.503/2023 of murder, criminal conspiracy and offences under the Arms Act. The prosecution alleged that the petitioners participated in a conspiracy to kill the complainant’s husband over a land dispute and political rivalry, and opposed bail on the ground of multiple criminal antecedents. The petitioners contended that they were falsely implicated and relied on a confessional statement of a co‑accused, which implicated another accused and admitted the petitioners’ involvement only in conspiracy. The Court examined the material on record, noted that no substantive evidence besides the co‑accused’s confession linked the petitioners to the crime, and considered the bail granted to other co‑accused. Accordingly, the Court ordered bail for both petitioners on a bond of Rs 10,000 with two sureties, subject to conditions of cooperation, non‑tampering with evidence, and verification of criminal antecedents.
Issues considered
- Whether bail should be granted to the accused in a murder and conspiracy case under Sections 302, 120(B), 34 IPC and Section 27 Arms Act, considering the nature of the offences and the petitioners’ criminal antecedents.
