Punita DeviversusThe State of Bihar

Decided

BAIL GRANTED

Holding

Bail was granted to the petitioner subject to conditions, as there was no specific allegation of assault against her and she has a clean antecedent.

Summary

Punita Devi, the wife of co-accused Ram Prasad Sahani, was arrested in connection with a violent assault case (PS Case No. 522 of 2025) under Sections 103(1) read with 3(5) of the Bharatiya Nyay Sanhita, 2023. The FIR details an attack on Rajesh Kumar Sahani by several male relatives, but does not specifically allege any assault by the petitioner. She has been in custody since 13 February 2026 and claims a clean criminal record. The prosecution opposed bail, while her counsel argued that she was falsely implicated and no specific charge of assault was made against her. The court, noting the absence of a direct allegation and her clean antecedent, granted bail on a Rs.10,000 bond with two sureties and imposed standard conditions for cooperation, non‑tampering with evidence, and verification of antecedents.

Issues considered

  • Whether bail should be granted to a co‑accused who has no specific allegation of assault against her in the FIR.
  • Whether the petitioner’s clean antecedent and lack of direct charge justify release on bail under the Bharatiya Nyay Sanhita, 2023.
