Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner with specified conditions.

Summary

The petitioner, Mantu Kumar, was arrested on 16 March 2026 in connection with a case involving the seizure of 378 litres of Nepali liquor under Section 30(a) of the Bihar Prohibition and Excise Act. He claimed to have a clean antecedent and argued that the liquor was recovered from three motorcycles that he did not own, asserting that he was not in conscious possession and that the police failed to comply with Sections 103 and 105 of the BNSS. The Additional Public Prosecutor opposed bail. The court considered the lack of direct possession, the petitioner’s clean record, and procedural lapses, and consequently ordered his release on bail with a bond of Rs. 10,000 and two sureties, subject to conditions regarding cooperation, non‑tampering with evidence, and verification of antecedents. The bail bond was to be accepted without delay for verification. The order was pronounced by Justice Rajesh Kumar Verma.

Issues considered

  • Whether bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the petitioner was in conscious possession of the seized liquor.
