BAIL GRANTED

Holding

The Court granted bail to the petitioner, subject to a bond and sureties.

Summary

Suraj Ram, a B.Sc. Agriculture student, was arrested in connection with a cyber fraud case (Cyber P.S. Purnia Case No. 45 of 2025) alleging that he supplied customer IDs to co‑accused Keshav Kumar for illegal withdrawals. He faced charges under several sections of the Bihar Negotiable Instruments Act and the Information Technology Act. After an earlier bail application was withdrawn, he filed a fresh bail petition following the framing of charges on 27‑02‑2026, asserting that no money was ever transferred through his bank account and that he had no criminal antecedents. The State opposed the bail, contending the seriousness of the offences. The Court, noting the absence of any transaction in the petitioner’s account, his prolonged pre‑trial custody, and the liberty previously granted to re‑apply, ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to his cooperation with the investigation.

Issues considered

  • Whether the petitioner, alleged to have facilitated cyber fraud, is entitled to bail after charges have been framed.
  • Whether the nature of the offences under the Bihar Negotiable Instruments Act and the IT Act warrants denial of bail.
