Patna High Court

Munna Kumar @ Munna SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, finding that the evidence did not warrant continued detention.

Summary

Munna Kumar was arrested in connection with a case involving murder, attempted murder, criminal conspiracy and an offence under the Arms Act. The prosecution alleged that he participated in the killing of Ranjan Kumar in retaliation for earlier killings of his grandfather. The petitioner contended that he was falsely implicated, pointing out that two trial witnesses gave no incriminating testimony and that only his own confessional statement linked him to the crime. He had been in custody since 15 January 2025. The court, after hearing counsel, found the evidence insufficient to deny bail and ordered his release on bail with a bond of Rs. 10,000 and two sureties.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences under Sections 302, 307, 120(B), 34 of the IPC and Section 27 of the Arms Act
  • Whether the confessional statement alone, in the absence of corroborative evidence, justifies continued detention
