Holding
Bail was granted on the ground that the allegations were non‑specific, the petitioner had a clean antecedent, and the charge sheet had been filed, making bail appropriate under Section 480(3) of the B.N.S.
Summary
The petitioner, Ranjan Kumar, was arrested in connection with alleged offences under Sections 310(4) and 310(5) of the B.N.S. and several provisions of the Arms Act, based on a police raid that recovered a foldable knife and a mobile phone. He claimed innocence, asserting that the knife allegation was false and the phone belonged to him, and highlighted his clean antecedent and the fact that he had been in custody since 21‑10‑2025 with a charge sheet already filed. The State opposed bail, contending that the FIR indicated his participation in a serious criminal gang. The court examined the non‑specific nature of the allegations, the petitioner’s long custody, clean record, and the filing of the charge sheet, and applied Section 480(3) of the B.N.S. to assess bail eligibility. Consequently, the court ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions including a close relative as bailor and mandatory court appearances. The bail order was conditioned on compliance with the stipulated terms and the possibility of cancellation for violations.
Issues considered
- What is the applicability of Section 480(3) of the B.N.S. in granting bail to an accused charged under Sections 310(4) and 310(5) of the B.N.S. and the Arms Act?
- Whether the non‑specific nature of the allegations, the petitioner’s clean antecedent, and the period of custody justify granting bail despite the seriousness of the offences.
