Decided
Disposal
BAIL REJECTED

Holding

The court refused to grant bail to the petitioner.

Summary

Petitioner Ravindra Kumar Sah was arrested in connection with a case registered on 12 June 2023, facing charges under several IPC sections (363, 366A, 376, 323, 504/34), the POCSO Act (sections 4 and 6) and the SC/ST (Prevention of Atrocities) Act. He filed a criminal miscellaneous application seeking regular bail, claiming innocence and that the victim's evidence had already been recorded. The State and the informant contended that the victim’s testimony implicated the petitioner, including an allegation of rape. The court noted that the victim’s evidence had indeed been taken and that serious offences were alleged. Consequently, the court refused to grant bail, dismissing the petitioner's application.

Issues considered

  • Whether regular bail should be granted to the petitioner in light of the serious charges including rape, theft, kidnapping and offences under the POCSO and SC/ST Acts.
