Chandan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to bond and conditions.

Summary

The petitioner, Chandan Kumar, was arrested in connection with a robbery in which five persons on two motorcycles allegedly snatched a motorcycle and valuables from an informant. The prosecution’s case is based on a confessional statement of co‑accused Nitish Kumar, who named the petitioner as a participant; no identification parade was conducted. The petitioner contended that he was falsely implicated and highlighted the lack of direct evidence, his custody since November 2024, and that he is on bail in two of four other cases. The State opposed bail, citing the seriousness of the offence under Section 310(2) of the BNS. The Court, considering the absence of an identification parade, the charge sheet, and the petitioner’s prolonged custody, granted bail on a bond of Rs.10,000 with two sureties and conditions under Section 480(3) of the BNSS.

Issues considered

  • Whether bail should be granted in a case of alleged robbery under Section 310(2) of the BNS given the circumstances of the investigation.
  • Whether the absence of an identification parade and reliance on a co‑accused’s confessional statement affect the bail decision.
