Patna High Court

Md. Arij Khan @ Md Arij @ Ezaz @ ArifversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner.

Summary

The petitioner, Md. Arij Khan, sought anticipatory bail fearing arrest in a kidnapping case (Madhubani P.S. Case No. 116 of 2025) under Sections 137(2) and 140(3) of the Bihar Narcotic Substances Act, 2023. He alleged that the minor victim returned home voluntarily and that he was falsely implicated. The State opposed the bail application. The Court, noting the petitioner’s clean antecedents and the circumstances, granted anticipatory bail subject to a bond of Rs.10,000 and two sureties, and imposed conditions under Section 438(2) of the Code of Criminal Procedure and Section 482(2) of the BNSS. The order directs release if arrested or surrendered within four weeks, pending compliance with the stipulated conditions.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC in view of the allegations under Sections 137(2) and 140(3) of the BNSS, 2023.
  • Whether the petitioner’s clean antecedent and the victim’s voluntary return justify the grant of bail.
