Patna High Court

Laleshwar Singh @ Lal SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court ordered the release of the petitioner on bail subject to conditions under Section 480(3) of the Bharatiya Nyaya Sanhita.

Summary

Laleshwar Singh petitioned for bail in a case (P.S. Case No. 123 of 2025) alleging his involvement in an assault on the informant's husband, charged under multiple sections of the Bharatiya Nyaya Sanhita, 2023. The prosecution claimed he instigated the assault, while the petitioner argued the charges were false and stemmed from a land dispute, asserting that he was merely the alleged order‑giver and that the informant had previously filed a complaint against him. He had been in custody since 12‑12‑2025 and a charge‑sheet had been filed. The State opposed bail. Considering the circumstances, the period of custody, and the pending charge‑sheet, the court granted bail on a bond of Rs.10,000 with two sureties and imposed conditions under Section 480(3) of the BNS. The bail order required the petitioner’s presence at court dates and stipulated cancellation of bail upon repeated non‑appearance.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences under the Bharatiya Nyaya Sanhita.
  • Whether the allegations against the petitioner are false and arise from a land dispute, affecting the bail decision.
  • Applicability of Section 480(3) of the Bharatiya Nyaya Sanhita in granting bail.

2 17-04-2026 Heard learned counsel for the petitioner and learned

                   APP for the State.

                                02. In the present case, the petitioner seeks bail in

connection with Pator P.S. Case No. 123 of 2025 registered for

                   the alleged offences under Sections 126(2), 115(2), 109(1), 74,

                   352, 351(2) r/w 3(5) of Bharatiya Nyaya Sanhita, 2023.

                                03. As per prosecution case, the petitioner stopped the

husband of the informant while he had been going to market for

some urgent work and other co-accused persons assaulted him

with lathi and sword at the instigation of the petitioner, causing

a number of injuries to the husband of the informant.

                                04. Learned counsel for the petitioner submits that the

petitioner is innocent and has been falsely implicated in this

case. The allegations are completely false and concocted. Land

dispute is apparent from the FIR itself and in the background of

land dispute, the husband of the informant and others assaulted

the petitioner and his wife and wife of this petitioner has lodged

Pator P.S. Case No. 31 of 2025 against the informant and others.

In order to put pressure upon the petitioner, this false case has

been lodged. Even from the contents of the FIR, it is apparent

that no specific allegation of assault has been levelled against

the petitioner and only allegation is that of he is the order giver

to the assailants. Learned counsel further submits that the

informant has filed a complaint case bearing No. 328 of 2025

against the petitioner under Section 115(2) of BNS. The

petitioner is in custody since 12.12.2025 and charge-sheet has

          been submitted.

                       05. Learned APP for the State opposes the submission

made on behalf of the petitioner.

                       06. Having regard to the facts and circumstances and

submissions made on behalf of the parties and considering the

earlier lodged case of the petitioner’s side and further

considering the period of custody of the petitioner along with

submission of charge-sheet, the petitioner above named is

directed to be released on bail on furnishing bail bonds of Rs.
