Munni Devi @ Munni Kumai DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to the conditions imposed by the court.

Summary

Munni Devi, a 58‑year‑old woman, was implicated in a case (PS 103/2025) alleging assault on an informant's son with bricks, charged under several sections of the B.N.S. She contended that the allegations were vague, she was falsely implicated, and she had a clean criminal record. The State opposed her request for anticipatory bail. The court examined the lack of specific allegations against her and her clean antecedent, and considered the statutory provisions governing anticipatory bail. It granted anticipatory bail under Section 438(2) of the CrPC read with Section 482(2) of the B.N.S.S., imposing conditions such as surety bonds, presence in court, and possible cancellation for non‑compliance. The order clarified that any observations made would not affect the trial.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 of the CrPC in view of the allegations and her criminal antecedent.
