The court granted regular bail to the petitioners.

Summary

The petitioners, Angrahit Bind and Bhuar Bind, applied for regular bail in a case registered under several sections of the B.N.S. for alleged assault with intent to kill. The prosecution alleged that the petitioners, armed with weapons, attacked an informant and his associates, causing injuries. The petitioners contended they were innocent, the injuries were simple, they had no prior criminal record, and similar co‑accused had been granted bail in a recent case. The State opposed the bail application. After hearing both sides, the court found the petitioners' circumstances warranted bail and ordered them to be released on a bail bond of Rs. 10,000 with two sureties each.

Issues considered

  • Whether the petitioners are entitled to regular bail despite charges under Sections 126(2), 115(2), 117(2), 109, 351(2), 351(3), 352 and 3(5) of the B.N.S.
  • Whether the nature of the alleged injuries and the petitioners' lack of criminal antecedents justify granting bail
  • Whether the precedent of bail granted to similarly situated co‑accused in Cr. Misc. No. 24523 of 2026 is applicable

Legislation cited
